Obiectul prezentei investigaţii îl reprezintă cele mai relevante aspecte teoretice şi practice ale infracţiunilor de omor săvârşite în stare de afect (art.146 CP RM) şi de pruncucidere (art.147 CP RM). Ambele infracţiuni analizate sunt săvârşite prin omor. În afară de aceasta, ele se aseamănă prin responsabilitatea redusă a persoanei care le săvârşeşte. Însă, în afară de similitudini, infracţiunile prevăzute la art.146 şi 147 CP RM se caracterizează prin anumite diferenţe specifice. Acestea se referă la: victima infracţiunii; timpul de săvârşire a infracţăţile tării emoţionale a subiectului infracţiunii; subiectul infracţiunii. Conţinând multiple referiri la xemplele din practica judiciară, studiul de faţă are ca repere următoarele aspecte teoretice:obiectul juridic special; obiectul material; victima; conţinutul faptei (acţiunii sau inacţiunii) prejudiciabile; urmările prejudiciabile ale infracţiunii şi legătura cauzală; alte semneale laturii obiective a infracţiunii; indicarea tipului componenţei de infracţiune în funcţiede rezultatul infracţiunii (componenţă materială); momentul de consumare a infracţiunii;forma şi tipul vinovăţiei; motivul şi scopul infracţiunii; starea emoţională a subiectului infracţiunii; condiţiile generale şi speciale ale subiecului infracţiunii.
The object of this investigation are the most relevant theoretical
and practical aspects of the offence of murder committed in the state of affection (art.146 PC RM) and infanticide (art.147 PC RM). Both analyzed offences are committed through murder. In addition, they are similar by the reduced responsibility of the perpetrator. However, apart from similarities, he offences under art.146 and 147 PC RM are characterized by certain pecific differences with regard to the victim of the offence, the time of erpetration of the offence, the emotional peculiarities of the subject of theoffence and the subject of the offence. Covering multiple examples of judicial practice, this study has the following theoretical benchmarks: thespecial legal object; the material object; the victim; the contents of the rejudicial act (action or inaction); the prejudicial consequences of the ffence and the causal linkage; the other signs of the objective side of the offence; the indication of the composition of the offence by it’s outcome (the material composition); the consumption of the offence; the form and ype of guilt; the motive and purpose of the offence; the emotional state of he subject; the general and special conditions of the subject.
