Abstract:
The death penalty and life imprisonment are exceptional punishments under criminal
law, but this does not allow them to violate fundamental human rights, in particular the
right to life, thus trying to preserve, as far as possible, the civil life that the individual had
before detention. As for the death penalty, the argument with the highest yield is the existence of error, which in the circumstances cannot be corrected.
