Abstract:
The resocialization process is complex and continuous whether the minor is the
probation subject or is sentenced to the deprivation of liberty punishment. The success of the
activities carried out in this process depends on all the involved parties. The resocialization is
the core element of probation and the legal definition demonstrates that probation represents a
psychosocial assessment, control of people in conflict with the criminal law and their
resocialization, adaptation of people released from detention to prevent the commission of new
crimes.
Children in conflict with the law are a category of probation beneficiaries to whom the same
measures, the same stages of resocialization are applied, but the approach is a special one,
taking into account the obligation to respect the best interest of the child. The same principle is
available to children in detention in respect of whom the prison sentence is applied as a last
resort.
