INFRACŢIUNILE PREVĂZUTE LA art.255 CP RM: ASPECTE DE DREPT PENAL

Abstract

Obiectul prezentului studiu îl constituie elementele constitutive şi circumstanţele agravante ale infracţiunilor prevăzute la art.255 CP RM. În acest context, sunt analizate obiectul juridic şi obiectul material al respectivelor infracţiuni. De asemenea, este definită noţiunea „consumator”, care desemnează victima infracţiunilor specificate la art.255 CP RM. În continuare, sunt supuse examinării cele trei modalităţi normative ale faptei prejudiciabile reprezentând aceste infracţiuni.În legătură cu analiza subiectului infracţiunilor prevăzute la art.255 CP RM, sunt definite noţiunile „distribuitor”,„vânzător” şi „prestator”. Nu în ultimul rând, sunt stabilite condiţiile de operare a circumstanţei agravante consemnate la lit.b) alin.(2) art.255 CP RM, presupunând săvârşirea infracţiunii de două sau mai multe persoane.

This study worked with the constituent elements and the aggravating circumstances of the offences provided by art.255 PC RM. In this context, there are analyzed the legal object and the material object of these offences. It is also defined the term “consumer”, which designates the victim of the offences specified at art.255 PC RM. Further are examined the three normative forms of the prejudicial act describing the offences in question. With regard to the analysis of the subject of the offences referred to at art.255 PC RM, there are defined the notions “distributor”, “seller” and “provider”. Finally but not least, there are set the operating conditions of the aggravating circumstance recorded at lett.b) par.(2) art.255 PC RM, with regard to the offence committed by two or more persons.
