Conform legislaţiei în vigoare, părinţii sunt reprezentanţii legali ai copiilor lor şi sunt obligaţi să acţioneze în interesele
acestora în raport cu toate persoanele fizice şi juridice, inclusiv cu autorităţile statului. Convenţia ONU privind
drepturile copilului din 1989 subliniază, în Preambul, că familia este unitatea fundamentală a societăţii şi mediul natural
pentru creşterea şi bunăstarea tuturor membrilor săi, în mod deosebit a copiilor. Studiile în acest domeniu au constatat
că pentru dezvoltarea deplină şi armonioasă a personalităţii copilului el are nevoie de dragoste şi înţelegere în familie.
Oriunde este posibil el trebuie să crească sub grija şi răspunderea părinţilor săi într-o atmosferă de afecţiune şi securitate
morală şi materială, care îi va asigura o dezvoltare fizică normală, spirituală, intelectuală şi socială ca el să devină personalitate.
În cazurile în care părinţii nu-şi îndeplinesc obligaţiile sau abuzează de drepturi, organele de stat se implică şi
iau măsurile necesare pentru ocrotirea minorilor, lipsindu-i pe părinţi de drepturi sau limitând aceste drepturi.
According to the legislation, parents are the legal representatives of their children and are obliged to act in their
interest in relation with all of human persons and legal persons, including state authorities. UNO convention concerning
rights of the child, dating 1989, in preamble highlights that family is a fundamental unit of the society and a natural
environment for growing and welfare of all its members, especially of children. Studies in this field established that
for full and harmonious development of the child personality he needs love and understanding in the family. Anywhere
it is possible he should grow under care and responsibility of his parents, in a fondness, material and moral secured
environment that will assure him a normal physical, spiritual, intellectual and social development in the way to become
a personality. In case when parents do not execute their obligations or abuse of their rights, state bodies get involved
and take the necessary measures for infant protection, depriving them of parental rights or limiting such one.
