MODELUL FRANCEZ ŞI CEL BELGIAN AL RĂSPUNDERII PERSOANELOR JURIDICE PENTRU COMITEREA FAPTELOR INFRACŢIONALE

Abstract

La ziua de azi, legislaţia penală referitoare la răspunderea persoanelor juridice rămâne restantă în coraport cu dezvoltarea dinamică a sferei economice a societăţii. Drept confirmare a acestui fapt pot servi cercetările criminologice care evidenţiază o creştere stabilă a numărului de infracţiuni, în special al celor comise de către persoanele juridice. Aceasta ne vorbeşte despre faptul că sancţiunile prevăzute de normele de drept penal pentru faptele ilegale comise de persoanele juridice nu constituie o piedică în calea activităţii socialmente periculoase şi infracţionale a acestora, în special din considerentul că beneficiul, venitul obţinut de multiple ori depăşeşte sumele amenzilor achitate. Totodată, mai persistă şi un spectru de factori care împiedică aplicarea eficientă a prevederilor normative referitoare la răspunderea penală a persoanei juridice pentru fapte infracţionale, ei ţinând de domeniul prevederilor doctrinare dure referitoare la trăsăturile subiectului infracţiunii şi la temeiurile tragerii acestuia la răspundere penală. Necesitatea unei studieri multiaspectuale a acestei probleme este determinată de evoluţia continuă a perceperii ştiinţifice a persoanei juridice în calitate de subiect al infracţiunii şi al răspunderii penale pentru faptele infracţionale comise. Actualmente, se observă tendinţa de a intensifica răspunderea penală a persoanelor juridice pentru faptele infracţionale comise.

As of today, the criminal legislation relating to the liability of legal entities remains outstanding in correlation with the dynamic development of the economic sphere of society. As evidence of this can serve criminological researches that highlight a steady growth of the number of crimes, especially those committed by legal entities. This tells us that the penalties laid down by the criminal law for unlawful acts committed by legal entities are not a hinder in the way of their socially dangerous and offensive activity, mainly on the grounds that the benefit, the income earned is multiple times greater than the amounts of fines paid. However, there are still a range of factors that impede the effective implementation of legal provisions related to criminal liability of legal entities for criminal acts, as they are related to the field of tough doctrinal provisions relating to the characteristics of the subject of offense and to grounds for attracting the criminal liability. The need for a multidimensional study of this problem is determined by the continuous evolution of the scientific perception of a legal entity as a subject of crime and its criminal liability for criminal acts committed. Currently, there is noticed a tendency to intensify the criminal liability of legal entities for criminal acts committed
