În acest articol sunt prezentate rezultatele cercetării în materie de drept comparat a unor aspecte privind măsurile de siguranţă: conceptul şi sistemul măsurilor de siguranţă. Se arată că în majoritatea sistemelor de drept măsurile de siguranţă sunt definite ca fiind simple precauţii de protecţie socială destinate să prevină recidiva unui delincvent sau să
neutralizeze starea periculoasă. Ele se disting de pedepse prin fundamentul, scopul şi conţinutul lor. Temeiul măsurilor de siguranţă nu este vinovăţia delincventului, ci starea de pericol pe care el o prezintă.
In this article we present the results of the research in comparative law, some aspects regarding safety measures: the concept and system of safety measures. We show that in most systems of law the safety measures are defined as simple cautions of social protection meant to avert the reccurence of a felon or to neutralize the dangerous estate. They can be distinguished from the punishments through their foundation, purpose and content. The basis of safety measures does
not reside in the guilt of the felon, but in the estate of danger that he represents.
