Abstract:
This article demonstrates the importance of mutual assistance for transfer of supervision of offenders conditionally sentenced or conditionally released. The aim of mutual recognition and supervision of conditional suspended sentences or conditional release decisions is to enhance the prospects of the sentenced person’s being reintegrated into society, by enabling that person to preserve family, linguistic, cultural and other ties, with a view to preventing recidivism, to protect victims and the general public. The development of international cooperation in criminal matters will help to ensure security and the rule of law, increase the efficiency of justice, and will guarantee better protection of human rights and freedoms. States need to stimulate policies to facilitate mutual legal assistance, implement existing instruments, be open to accepting new ones, and diversify them in order to simplify procedures of recognition.
