În conformitate cu Convenţia de la Haga din 1980, copiii deplasaţi sau reţinuţi în mod ilicit, ca urmare a acestor despărţiri, trebuie să fie înapoiaţi rapid în ţara în care îşi au reşedinţa obişnuită. Instanţele din ţara în care copiii îşi au reşedinţa obişnuită se pronunţă cu privire la fondul litigiului privind încredinţarea. Sub acest aspect este foarte important ca instanţele din ţara din care copilul a fost deplasat să dispună înapoierea în termen de şase săptămâni de la data depunerii cererii de înapoiere, stabilind un echilibru echitabil între interesele părinţilor şi interesul superior al copilului.
The constant movement of people worldwide has led to an increase of the number of internationally dimensioned families. Improved family mobility contributes to the intensification of the noticeable trend regarding divorces and separations with cross-border implications. According to The Hague Convention, children who have been wrongfully displaced or detained as a result of such separations must be returned promptly to the country in which they have their habitual residence. The courts of the country in which they have their habitual residence shall rule on the substance of the entrustment dispute. In this respect, it is very important that the national courts of the country from which the child was moved order the return within six weeks of the date on which the request for return was lodged, thus establishing a fair balance between the interests of the parents and the best interests of the child.
