Cтатья посвящена некоторым дискуссионным вопросам конфискации имущества, встречаемым в уголовном
законодательстве и прецедентном праве Объединенного Королевства Великобритании. Автор подверг тщательному исследованию не только британское законодательство, но и процедуру конфискации как таковую. На сегодняшний день режим конфискации, применяемый в Великобритании, регламентируется тремя нормативными актами: Законом об уголовной юстиции 1988 года, Законом о преступлениях, связанных с незаконной торговлей наркотиками 1994 года, Законом об уголовном процессе 2002 года. Вместе с тем, суд имеет право использовать положения и других нормативных актов, в частности, Закон о злоупотреблении наркотиками 1971 года,Закон о борьбе с терроризмом 2000 года. Соответственно, не все формы конфискации осуществляются на
основании Закона об уголовном процессе 2002 года.
Materia abordată în acest articol vizează unele aspecte discutabile ce
ţin de confiscarea averii în conformitate cu legislaţia penalăşi precedentul judiciar din Regatul Unit. Аutorul a supus unei examinări detaliate nu doar legislaţia britanică, ci şi procedura judiciară
de efectuare a acesteia. Astfel, la momentul actual în Marea Britanie regimul de confiscare este reglementat de trei acte normative: Legea justiţiei penale din 1988, Legea privind infracţiunile legate cu
vânzarea de droguri din 1994, Legea privind procesul penal din 2002. Totodată, instanţa de judecată are dreptul de a aplica prevederi
şi din alte acte normative, după cum urmează: Legea privind abuzul de droguri din 1971, Legea privind combaterea terorismului din 2000. Prin urmare, nu toate formele confiscării sunt efectuate în baza legii din 2002.
This scientific article deals with some disputable aspects
of the forfeiture of estate in the legislation and precedent
law of the United Kingdom of Great Britain. In order to
achieve some progressive lawmaking experience the author
submits to a detailed explanation the modern legislation and the opinions of judicial instances regarding the forfeiture
and the procedure of confiscation. The current confiscation regime in the United Kingdom of Great Britain consists of three pieces of legislation; the Criminal Justice Act 1988 (as amended by the Pr
oceeds of Crime Act 1995), the Drug Trafficking Act 1994 and the Proceeds of Crime Act 2002. It should be noted however that the Court has the power to make other financial orders, for example fines, deprivation or forfeiture orders under the Misuse of Drugs Act 1971 or
the Terrorism Act 2000. Not all confiscation is made under the Proceeds of Crime Act 2002.
