Abstract:
This article aims at providing the approach towards the problem based on fundamental
rule of the legal regime of transboundary waters of the principle of “reasonable and equitable use”, according to which each basin state has the right, to a reasonable and equitable share of the benefits of the use of the waters of that basin.These norms were originally provided for in the 1966 Helsinki Rules for the Use of International River Waters, updated and revised by the International Law Association in another act - the Berlin Rules on Water Resources.Although Article 4 (2) of the Rome Bilateral Agreement (2012) provides for the obligation of the Parties to use the water resources of the Dniester River basin fairly and rationally, it is extremely important that this principle be extended and developed, taking into account the current situation and the perspective of the sustainable development of this basin.
