Obiectul prezentului studiu îl constituie infracţiunile prevăzute la art.160 „Efectuarea ilegală a sterilizării chirurgicale”,
art.161 „Efectuarea fecundării artificiale sau a implantării embrionului fără consimţământul pacientei”, art.162 „Neacordarea
de ajutor unui bolnav” şi art.163 „Lăsarea în primejdie” din Codul penal. Au fost stabilite elementele constitutive
şi elementele circumstanţiale agravante ale acestor infracţiuni care pun în pericol viaţa şi sănătatea persoanei. Examinarea
caracteristicilor acestor elemente este ilustrată prin exemple din practica judiciară
The object of this study is the offenses referred to at art.160 "Illegal performing of surgical sterilization", art.161 "Performing artificial fertilization or embryo implantation without the consent of the patient", art.162 "Withholding aid from a patient" and art.163 "Leaving in danger" of the Penal Code. There were established th
e constituent and aggravating circumstantial elements of these offenses, threatening the person’s life and health. The examination of the characteristics of these elements is illustrated through examples from practical law.
