Studiul de faţă conţine analiza juridico-penală a infracţiunilor prevăzute la art.241 CP RM. Printre altele, se argumentează că desfăşurarea unor genuri de activitate interzise de legislaţie (în sensul lit.b) art.125 CP RM şi, implicit, al art.241 CP RM) trebuie deosebit ă de: desfăşurarea unor genuri de activitate permise în mod exclusiv întreprinderilor de stat; desfăşurarea activităţii de întreprinzător fără licenţă. De asemenea, sunt propuse criteriile de delimitare a infracţiunilor specificate la art.241 CP RM de infracţiunile prevăzute la art.1852, 2411, 244, 2461,361 şi altele din Codul penal,
precum şi de faptele adiacente de facturăţională sau fiscală. Printre aspectele de noutate ale studiului de faţătrebuie remarcată revizuirea concepţiei de identificare a variantelor-tip şi a variantelor agravate în cazul infracţiunilor prevăzute la art.241 CP RM. În acest plan, se stabileşte că la lit.f) alin.(2) art.241 CP RM este consemnată nu o circumstanţă agravantă a infracţiunii specificate la alin.(1) art.241 CP RM. De fapt, la alin.(1) şi la lit.f) alin.(2) art.241 CP RM sunt prevăzute infracţiuni de sine stătătoare. Aceste infracţiuni se pot afla între ele în concurs.

to the offences under art.241 PC RM. As a result, is establis
hed that at lett.f) par.(2) art.241 PC RM is recorded not an
aggravating circumstance of the offence specified at par.(1) art.241 PC RM. In fact, at par.(1) and lett.f) par.(2) art.241
PC RM are provided independent offences. These offences can find each other in competition between themselves.
