Целью настоящего исследования являлось уяснение
правовой природы конфискации имущества и определение
ее места вне системы мер уголовно-правового воздействия.
Для достижения указанной цели автором рассматриваются
различные точки зрения, высказываемые в научной литературе,
применительно к определению природы и процедуры конфискации.Как
следствие,
доказывается
превентивная
природа
конфискации
имущества,
направленная, по
мнению автора, на устранение
последствий совершения
преступления,
на
предупреждение совершения
правонарушений в
будущем, которая
не
может
быть
сведена
только к
мерам
уголовно-правового
характера
Scopul acestui studiu rezidă în elucidarea naturii juridice a conficării
şi în stabilirea locului acesteia în afara sistemului măsurilor de constrângere cu caracter penal. Întru atingerea scopului preconizat autorul supune unei analize detaliate diverse opinii expuse în literatura de specialitate referitoare la determinarea naturii juridice
și a procedurii confiscării. În opinia autorului, natura preventivă a confiscării este îndreptată spre înlăturarea consecințelor faptei infracționale şi spre prevenirea comiterii încălcărilor legii pe viitor. S-a demonstrat că această măsură nu poate fi limitată doar la una cu caracter penal, ci și extrapenal.
The basic purpose of the present study consists in the elucidation of the legal nature of the forfeiture of estate as well as determination of its place outside the system of compulsory penal measures. In
order to obtain this scope the author has analyzed different points of view which are met in the modern penal doctrine regarding the determination of the legal nature of the forfeiture and the procedure of confiscation. Finally, there is demonstrated the preventive role of the
forfeiture which is directed to the elimination of the consequences of the criminal offence and its prevention for the future as well as had demonstrated that the institution of forfeiture outside the Substantive Criminal Law.
