Prezentul studiu este destinat ineficacităţii actului juridic civil, cunoscută în diferite state
şi ca ineficienţă, în contextul noilor modificări ale Codului civil. Ținând cont
de faptul că pentru prima dată Codul civil reglementează regimul juridic al actului juridic inficient, acest demers ştiinţific prezintă interes sporit, graţie actualităţii pe
care o are. Cauzele de ineficienţă, prevăzute la moment în legislaţie, derivă de la vechile cauze de nulitate ale actului juridic civil, motiv pentru care s-a analizat diferenţa dintre
ineficienţă şi nulitate, în ceea ce vizează efectele pe care le produc.
The present study is aimed at the ineffectiveness of
the civil legal act, known in different states and as
inefficiency, in the context of the new amendments
of the Civil Code. Taking into account the fact that
for the first time the Civil Code regulates the legal
regime of the inefficient legal act, these scientific
approaches are of great interest thanks to the current news.
The causes of inefficiency, currently regulated in
the legislation, derive from the old causes of nullity of the civil legal act, which is why the difference between inefficiency and nullity was analyzed, in terms of the effects they produce.
