Relațiile de muncă constituie un subiect actual și foarte discutat în contextul dezvoltării continue a societății moderneiar necunoașterea drepturilor și obligațiunilor atât a angajaților cât și a angajatorilor constituie un subiect de discuție
autentic ce conduce la apariția în continuare a conflictelor ce se soluționează în instanțele de judecată. Pentru un echilibru
în raporturile de muncă legislația în vigoare prevede atât drepturile cât și obligațiile salariaților. Conform Codului muncii,
salariatul are dreptul la încheierea, modificarea, suspendarea şi desfacerea contractului individual de muncă, în modul
stabilit de Cod precum și la achitarea la timp şi integrală a salariului, în corespundere cu calificarea sa, cu complexitatea,
cantitatea şi calitatea lucrului efectuat. Reieșind din analiza jurisprudenței naționale se desprinde concluzia că subiecții
raporturilor de muncă confundă instituțiile îndemnizațiilor și salariului ca drepturi salariale ce condiționează o serie de
litigii. În prezenta lucrare urmează a fi analizate noțiunile de „indemnizație” și „salariu” prin prisma legislației naționale
raportat la jurisprudența națională.
Constituie actuală problema cercetării subiectului drepturilor salariale în contextul importanței acestea în menținerea echilibrului aportului salariatului la munca depusă și neadmiterea încălcării drepturilor atât a angajatului cât și a angajatorului.
Labor relations are a current and highly discussed topic in the context of the continuous development of modern society, and the ignorance of the rights and obligations of both employees and employers is a genuine topic of discussion
that leads to the further emergence of conflicts that are resolved in the courts judgment. For a balance in the employment
relationships the legislation in force provides for both the rights and obligations of the employees. According to the Labor
Code, the employee has the right to conclude, modify, suspend and terminate the individual employment contract, in the
manner established by the Code as well as the timely and complete payment of the salary, according to his qualification,
complexity, quantity and quality of the work performed. Based on the analysis of national jurisprudence, it is concluded
that the subjects of the labor relations confuse the institutions of the allowances and the salary as wage rights that condition a series of disputes. In this paper, the notions of “allowance” and “salary” will be analyzed from the point of view of
national law in relation to national case law.
The issue of researching the subject of wage rights in the context of their importance in maintaining the balance of
the wage contribution to the work performed and not admitting the violation of the rights of both the employee and the
employer is the current issue.
