Prezintă un adevăr faptul că între stat și populația sa se încheagă o multitudine de raporturi de natură diversă, una fiind obiectiv necesară, legătură care nicidecum nu este întâmplătoare, ci formată urmare a unui îndelungat proces, în care atât populația cât și forța publică au conștientizat legăturile lor reciproce. Cetățenia este principiul care stă la baza legitimității politice şi constituie sursa unei legături juridico-politice existente între stat şi cetățean. Dar acesta nu este un principiu static, ci o construcție istorică, care ia forme concrete diferite în timp şi în spațiu. Societățile s-au schimbat în mod radical şi odată cu ele au evoluat şi concepțiile teoretice, şi modalitățile de aplicare a cetățeniei. Într-o societate democratică, cetățenia constituie una dintre componentele obligația socială, în special prin drepturile egale asociate acesteia. În prezenta lucrare a fost pus cu titlu de obiectiv cercetarea instituției cetățeniei prin prisma normelor de drept internațional public, dar și prin analiza reglementărilor la nivel național și în contextul jurisprudenței CtEDO.
It presents a truth that there is a multitude of different relations between the state and the population, one being an objective necessity, a connection that is not accidental but results from a long process in which both the public and the public force are aware their mutual ties. Citizenship is the principle behind political legitimacy and is the source of a legal-political link between the state and the citizen. But this is not a static principle, but a historical construction that takes different concrete forms over time and in space. The societies have changed radically and with them the theoretical conceptions and the ways of applying the citizenship have evolved. In a democratic society, citizenship is one of the components of the social obligation, especially through equal rights associated with it. In the present paper the objective of the research of the institution of citizenship was given in terms of the norms of the public international law, but also through the analysis of the regulations at national level and in the context of ECHR jurisprudence.
