CONSOLIDAREA NORMATIVĂ ȘI INSTITUȚIONALĂ A INTEGRĂRII MINORITĂȚILOR ETNICE ÎN REPUBLICA MOLDOVA

Abstract

Scopul lucrării rezidă în aprofundarea cercetării asupra integrării minorităților etnice în Republica Moldova, cu analiza reglementărilor internaționale și a experienței statelor ce întrunesc afinități istorice, politice și demografice cu Republica Moldova și care împărtășesc valori europene. Pentru realizarea scopului au fost trasate următoarele obiective de cercetare: de a argumenta necesitatea integrării minorităților etnice în vederea asigurării unității poporului și dezvoltării societății Republicii Moldova; de a demonstra că integrarea minorităților etnice este în corespundere cu prevederile referitoare la drepturile omului; de a analiza terminologia în domeniu și de a propune definiția proprie pentru termenul „integrare”; de a determina care dintre sintagmele „minoritate etnică” și „minoritate națională” este justă din punct de vedere a doctrinei și a contextului Republicii Moldova; de a identifica bunele practici din experiența europeană privind integrarea minorităților ce pot fi aplicate pentru perfecționarea cadrului normativ și instituțional din Republica Moldova; de a clarifica care sunt premisele principale pentru realizarea integrării minorităților etnice și de a determina în ce măsură acestea sunt întrunite în contextul cadrului normativ și instituțional din Republica Moldova.

Цель исследования состоит в комплексном анализе интеграции этнических меньшинств в Республике Молдова, путем анализа международных норм и опыта государств, имеющих историческую, политическую и демографическую сходство с Республикой Молдова, и разделяющих европейские ценности. Для этого, были поставлены следующие задачи: обосновать необходимость интеграции этнических меньшинств в целях обеспечения единства народа и развития общества Республики Молдова; продемонстрировать, что интеграция этнических меньшинств соответствует положениям о правах человека; проанализировать терминологию и предложить собственное определение термина «интеграция»; определить, какие из терминов «этническое меньшинство» и «национальное меньшинство» являются правильными с точки зрения доктрины и контекста Республики Молдова; выявить передовую практику европейского опыта в отношении интеграции меньшинств, которая может быть применена для улучшения нормативной и институциональной базы Республики Молдова; прояснить, каковы основные предпосылки для интеграции этнических меньшинств, и определить, в какой степени они соблюдаются в контексте нормативной и институциональной базы Республики Молдова.

The aim of the thesis is to deepen the research on the integration of ethnic minorities in the Republic of Moldova, by analyzing the international regulations and the experience of the states that have historical, political and demographic affinities with the Republic of Moldova and share European values. In order to achieve this aim, the following research objectives were drawn: to argue the necessity of integration of ethnic minorities in order to ensure the unity of the people and the development of the society of the Republic of Moldova; to demonstrate that the integration of ethnic minorities is in line with the provisions on human rights; to analyze the terminology in the field and to propose its own definition for the term “integration”; to determine which of the terms “ethnic minority” and “national minority” is right in terms of the doctrine and context of the Republic of Moldova; to identify the good practices within the European experience regarding the integration of minorities that can be applied for the improvement of the normative and institutional framework of the Republic of Moldova; to clarify what are the main premises for achieving the integration of ethnic minorities and to determine to what extent these are met in the context of the normative and institutional framework of the Republic of Moldova.
