PROVOCAREA INFRACŢIUNII ÎN CONTEXTUL MĂSURILOR SPECIALE DE INVESTIGAŢIE (I)

Abstract

Prezentul studiu este destinat abordării teoretico-practice a provocării infracţiunii de către agenţii statului. În acest sens, sunt scoase în evidenţă prevederile legale naţionale în materia provocării infracţiunii, precum şi practica Curţii Europene pentru Drepturile Omului care statuează asupra condiţiilor în a căror prezenţă cele comise constituie sau nu rezultatul unui comportament provocator din partea statului. De asemenea, se încearcă efectuarea delimitării între provocarea infracţiunii şi activitatea sub acoperire realizată în condiţiile legii.

The present study is intended for the theoretical and practical approach to entrapment by state agents. In this respect are highlighted the national legal provisions on the entrapment and the practice of the European Court of Human Rights stating the conditions in which the presence of the committed acts is or not the result of provocative behavior on the part of the state. Also, is trying making delimitation between entrapment and the undercover activity performed under the law.
