În cadrul prezentului articol, obiectul de investigaţie îl constituie infracţiunile prevăzute la art.236 şi 237 CP RM.
Prin prisma ultimelor amendamente operate în aceste articole, este efectuată analiza tehnico-legislativă şi juridico-penală a respectivelor infracţiuni. Un interes deosebit comportă concluziile privind obiectul material, produsul şi victima în cazul infracţiunilor prevăzute la art.236 şi 237 CP RM. De asemenea, merită atenţie reflecţiile asupra momentului de consumare şi etapele activităţii infracţionale în ipoteza infracţiunilor în cauză. Nu în ultimul rând, ies în evidenţă criteriile de delimitare a infracţiunilor prevăzute la art.236 şi 237 CP RM în raport cu faptele adiacente, în special în raport cu infracţiunile specificate la art.190 şi 196 CP RM.
In the present article , the subject of investigation is the offences referred to at art.236 and 237 PC RM. In the view of recent amendments made in these articles is performed the technical-legislative and the legal-penal analysis of the respective offences.
