LES LIMITLES DU DROIT CIVIL POUR ASSURER L’EQUILIBRE CONTRACTUEL EN DROIT FRANCAIS

Abstract

One of the essential elements in any legal act are the volition of the parties involved. In Roman law it was impossiblefor a person who did not will to exchange something of his property for another thing of value to him, to exchange it,and so forth. Of course, this volition needed to be expressly manifested, and clearly enough so that it did not createconfusion as to what the intent of each of the parties was. Vices of consent itself, though, were different and did imply legaleffects. The three vices of consent in Commun law were violence, error, and dolus.

Unul dintre elementele esenţiale aleoricărui act juridic este voinţa părţii contractante. În dreptul roman era imposibilăobligarea unei persoane de a schimba ceva din proprietatea sa pentru un alt bun sau de a schimba un alt bun de valoare pentru el. Desigur, este necesar ca această voinţăsă se manifeste în mod expresşi destul de clar, astfel încât să nu creeze o confuzie cu privire la ceea ce intenţioneazăde faptfiecare dintre părţile contractante la încheierea actului juridic.Viciile de consimţământ în sine, de şisunt diferite, implică aceleaşi efecte juridice. Cele trei vicii de consimţământ în dreptul civil clasic sunt: violenţa, eroarea şi dolul.
