În prezentul studiu autorul va demonstra că caracterul conţinutului normativ al actului normativ-juridic este unul dintre factorii ce caracterizează puterea juridică a actului normativ-juridic, determinând aplicabilitatea lui. Tot aici sunt generalizate şi actualizate, în corespundere cu legislaţia în vigoare, componentele ce caracterizează conţinutul normativ al actului normativ-juridic, fiind descrise problemele teoretice care au persistat în acest domeniu şi căile de soluţionare a lor. Prin prisma principiului priorităţii legii autorul încearcă să argumenteze necesitatea aprecierii caracterului conţinu-tului normativ al actului normativ-juridic ca unul dintre
factorii ce caracterizează puterea juridică a acestuia şi explică
importanţa cunoaşterii lui pentru ordinea juridică a Republicii
Moldova. Îşi expune punctul de vedere asupra modului de reglementare şi instituire în ordinea juridică a unor aşa categorii ale actului normativ-juridic cum sunt cel general, special şi excepţional, accentuând importanţa cunoaşterii caracterului conţinutului normativ al actului normativ-juridic pentru aplicarea corectă a acestuia la încadrarea juridică a unui fapt din viaţa cotidiană. Sunt specificate consecinţele nerespectării sau necunoaşterii importanţei acestui caracter. Se atrage atenţia la lacunele admise de legiuitor privitor la studierea caracterului normativ al actelor legislative.
The present article will demonstrate that the character of the normative content of the normative-juridical act is one of the factors characterizing the juridical power of the normative-juridical act by the fact that it can determine it be biggeror smaller. Here there should be generalized and actualized in correspondence with the legislation in force, its components characterizing the normative content of the normative-juridical act, we shall describe the theoretical problems, which have been persisting in this field and which are the ways of their solution. From the point of view of the principle of priority of law, the author will make an attempt to argument the necessity of appreciation of the character of the normative content of the normative
-juridical act as one of the factors, which characterizes its juridical power and will explain the importance of the knowledge of this moment for the juridical order of the Republic of Moldova. There will be described the point of view as to the mode of regulation and establishing of the existing juridical order of such categories like the
general normative -juridical acts, special and exceptional, there
will be stressed the importance of the knowledge of the character of the normative content of the normative-juridical act taking into consideration its correct application in legally harmonizing the facts appearing in every day activity and which can be the consequence of not respecting or not knowing the importance of the given character. Attention should be drawn on the drawbacks admitted by the lawmaker in the process of the elaboration of the law as to the problem of treatment of the normative character]n case of legislative acts, the notion of juridical authority should be mentioned, which is still not exposed at the level of law for the time being.
