The concept of the lapse originated from Roman private law, so the theoretical constructions of this concept are transposed from civil law. The extension of the applicability of the lapse in the internal legislation of the states of the world served only for a better understanding of its foundations, respectively, the present study will aim to highlight the particularities of this concept more from the perspective of civil law, appealing to foreign doctrine, especially the French, Italian, German, Romanian, as well as the history of the institution of the lapse with the influences it has suffered over time from French, Italian, German, and Romanian law.
Conceptul de caducitate a luat naștere din dreptul privat roman, așadar construcțiile teoretice ale acestui concept sunt transpuse din dreptul civil. Extinderea aplicabilității caducității în legislațiile interne ale statelor lumii a servit doar la o mai bună înțelegere a fundamentelor sale, respectiv, prezentul studiu va avea drept scop evidențierea particularităților acestui concept mai mult din perspectiva dreptului civil, făcând apel la doctrina străină, în special la cea franceză, italiană, germană, română, precum și la istoria instituției caducității cu influențele pe care le-a suferit de-a lungul timpului din partea dreptului francez, celui italian, german, precum și a celui din spațiul românesc.
