În cadrul prezentului demers ştiinţific este reflectată poziţia autorului vizavi de Hotărârea Curţii Constituţionale nr.18 din 04.07.2013 privind controlul constituţionalităţii unor prevederi din Codul penal nr. 985
-XV din 18 aprilie 2002 şi din Codul de executare nr.443-XV din 24 decembrie 2004, în redacţia Legii nr. 34 din 24 mai 2012 pentru completarea unor acte legislative. Hotărâre prin care au fost declarate neconstituţionale următoarele prevederi: articolul 98 alineatul (2) litera b1), articolul 1041 din Codul penal nr. 985-XV din 18 aprilie 2002, articolul 174 alineatul (31) şi articolul 2911din Codul de executare nr.
443-XV din 24 decembrie 2004, în redacţia Legii nr. 34 din 24 mai 2012 pentru completarea unor acte legislative. Acest demers ştiinţific
este fundamentat pe analiza punctelor de vedere doctrinare şi a legislaţie inaţionale ce vizează instituţia castrării chimice, fiind analizată temeinicia şi raţionalitatea argumentelor invocate în
hotărârea menţionată a Curţii Constituţionale. În rezultatul cercetării s
-a conchis asupra neconstituţionalităţii prevederilor legale privind castrarea chimică ca urmare a unei mari carenţe normative în materia reglementării respectivei măsuri de siguranţă şi a garanţiilor legisla
tive ce vizează respectarea drepturilor, libertăţilor constituţionale şi
a demnităţii umane, fiind aduse argumente suplimentare în vederea susţinerii respectivei hotărâri. Sunt propue recomandări în vederea ameliorării cadrului legal pertinent, astfel încât să corespundă standardelor internaţionale în materia drepturilor şi libertăţilor
fundamentale ale omului şi să nu contravină prevederilor Constituţiei Republicii Moldova.
Under this approach reflected the author's position opposite the
Constitutional Court Decision No.18 of 04.07.2013 on the constitutionality of provisions of the Criminal Code No.985-XV of 18 April 2002 and theEnforcement Code No.443-XV of 24 December 2004 as amended by Law No.34 of 24 May 2012 for the completion of certainacts, which were declared unconstitutional the following provisions: Article98 (2) b1), Article No.1041 of the Penal Code No.
985-XV of April 18, 2002. Article174(31) and 2911of the Enforcement Code No. 443-XV of 24December 2004 as amended by Law No.34
of 24 May 2012 for the completion of certainacts. This article isbased on the analysis of doctrinal views andthe national legislation concerning the institution of chemical castration, so to assess the validity andrationality ofthe arguments of mentioned Constitutional Court’s Decision. The result of the investigation was concluded on the unconstitutionality of the law stipulations on chemical castration as a result of a normative regulation gaps concerning
the safety and legislative guarantees for the respect of rights, constitutional freedoms and dignity, bringing additional
arguments to support the respective decision. There were proposed recommendations to improve the pertinent legal
frame work so as to match international standards on human rights and fundamental freedoms and not to come in conflict with the Constitution’s rules of Republic of Moldova.
