Стремление граждан к ограничению и защите информации о частной жизни не представляется новым явле-
нием. Право на частную жизнь – фундаментальное право любого человека. Соответственно, никто не может
быть подвергнут неправомерному вмешательству в свою частную, семейную жизнь, в особенности своего до-
машнего уклада и межличностного общения, никто не может подвергаться посягательствам на честь и собственное
достоинство. Несмотря на общее понимание частной жизни как некой неприкасаемой сферы, куда вторжение
третьих лиц является нежелательным, в доктрине остается и по сегодняшний день множество нерешенных
вопросов, в том числе обусловленных несовершенством законодательной базы и правоприменительной практики.
Tendinţa oamenilor de a limita accesulla informaţia privind viaţa
lorprivată nu poate fi recunoscută un fenomen nou. Dreptul la viaţ
aprivată reprezintă un drept fundamental al omului şi presupune că
nimeni nu poate fi supus imixtiunii ilegale în viaţa sa intimă, familială, în special în particularităţile mediului de trai şi alecomunicărilor inter
personale, nimeni nu poate fi supus atentatelor asupra cinst
ei şi demnităţii personale. Cu toate că conceptul vieţii private se
recunoaşte a fi unul general cunoscut,există totuşiunele divergenţe de păreri în dotrină, condiţionate în mare măsură de deficienţele
legislative şi de practica de aplicare a legii penale.
The desire to safeguard personal information is not a new phenomenon. Privacy is considered a fundamental human right, which the government is responsible for providing to its citizens. Thus, no one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation.
Everyone has the right to the protection of the law against such interference or attacks. However, the legal protection of privacy
varies greatly in the legal doctrine. Such a situation can be explained by the legislative deficiencies and obstacles
created in the domain of judicial practice.
