În prezentul articol autorii cercetează aspectele teoretico-practice a procedurii adresării la Curtea Europeană a Drepturilor Omului. Mulți dintre cetățenii Republicii Moldova se adresează la Curte pentru apărarea drepturilor încălcate. De mai mulţi ani, şi ca urmare a unor diverşi factori, Curtea este copleşită de numărul de cereri individuale. Or, marea majoritate a acestor cereri (peste 95%) sunt respinse, fără să fie examinate pe fond, pentru că nu a îndeplinit unul din criteriile de admisibilitate prevăzute de Convenţia Europeană a Drepturilor Omului. Această situație generează o dublă frustrare. Pe de o parte, având obligaţia de a răspunde fiecărei cereri, Curtea nu are posibilitatea de a se concentra, în termene rezonabile, pe cauzele care necesită o examinare pe fond, iar acest lucru nu are utilitate reală pentru justiţiabili. Pe de altă parte, acţiunile a zeci de mii de reclamanți sunt respinse fără drept de apel, deseori după ani de așteptare. Prin urmare, sunt foarte importante propunerile autorilor care trebuie să sporească garanțiile apărării drepturilor omului.
In this article, the authors explore the theoretical and practical aspects of the procedure for addressing the European Court of Human Rights. Many citizens of the Republic of Moldova apply to the European Court of Human Rights for the protection of violated rights. For several years and as a result of various factors, the Court has been overwhelmed by the number of individual applications. However, the vast majority of these applications (over 95%) are rejected, without being examined on the merits, because they did not meet one of the admissibility criteria provided by the European Convention on Human Rights. This situation creates a double frustration. On the one hand, having the obligation to respond to each request, the Court does not have the opportunity to focus, within a reasonable time, on cases that require a substantive examination, and this is of no real use to litigants. On the other hand, the actions of tens of thousands of applicants are rejected without appeal, often after years of waiting. The proposals of the authors, who must increase the guarantees of human rights protection, are very important.
Dans cet article, les auteurs étudient les aspects théoriques et pratiques de la procédure de saisine de la Cour européenne des droits de l'homme. De nombreux citoyens de la République de Moldova demandent au tribunal la défense de droits violés. Pendant de nombreuses années, et en raison de divers facteurs, le tribunal est submergé par le nombre de demandes individuelles. La grande majorité de ces demandes (plus de 95%) sont rejetées, sans être examinées au fond, car elles ne répondaient pas à l'un des critères de recevabilité fixés par la convention européenne des droits de l'homme. Cette situation génère une double frustration. D'une part, ayant l'obligation de répondre à chaque requête, la cour n'a pas la possibilité de se concentrer, dans un délai raisonnable, sur des affaires nécessitant un examen au fond, ce qui n'a pas d'utilité réelle pour les justiciables. D'autre part, les actions de dizaines de milliers de demandeurs sont rejetées sans droit d'appel, souvent après des années d'attente. Par conséquent, il est très important que les propositions des auteurs accroissent les garanties de la défense des droits de l'homme.
В представленном материале авторы рассматривают теоретические и практические аспекты процедуры обращения в Европейский суд по правам человека. Многие граждане Республики Молдова обращаются в Европейский суд по правам человека за защитой нарушенных прав. В течение нескольких лет и в результате действия различных факторов, Суд был перегружен количеством индивидуальных жалоб. Однако, подавляющее большинство этих заявлений (более 95%) отклоняется без рассмотрения по существу, поскольку они не соответствуют одному из критериев приемлемости, предусмотренных Европейская конвенция о правах человека. Данная ситуация вызывает двойное разочарование. С одной стороны, будучи обязанным отвечать на каждый запрос, Суд не имеет возможности сосредоточить внимание в разумные сроки на делах, требующих экспертизы по существу, и это не имеет реальной пользы для сторон в судебном процессе. С другой стороны, заявления десятков тысяч граждан отклоняются без апелляции, часто после многих лет ожидания. В этой связи, особо важными являются предложения авторов, направленные на повышение гарантии защиты прав человека.
