Instituţia responsabilităţii limitate a fost introdusă în Codul penal al Republicii Moldova în 2009. Potrivit noilor
reglementări, persoana care a săvârşit o infracţiune ca urmare a unei tulburări psihice, constatate prin expertiza medicală
efectuată în modul stabilit, din cauza căreia nu-şi putea da seama pe deplin de caracterul şi legalitatea faptelor sale sau
nu le putea dirija pe deplin, este pasibilă de responsabilitate penală redusă. Responsabilitatea limitată este aplicată în
calitate de circumstanţă atenuantă în multe jurisdicţii; totuşi, problemele se referă la sarcina probaţiei şi la aprecierea
probelor în instanţă pentru partea apărării în cazul invocării responsabilităţii limitate. Scopul acestui articol este de a
evidenţia specificul responsabilităţii limitate în familiile de drept common law şi romano-germanică, precum şi de a
identifica condiţiile necesare pentru a considera această instituţie o circumstanţă atenuantă

damage
with a

size
and
2) you
could
graft
as
aggravating
circumstances:
a) the pro
duction of an effective
patrimonial
damage
in small proportions
;
b
) the production of
an
effective
patrimonial
damage whose
size
is
within the range
of
25
-
2500
conventional units
; c) the production of
an
effective
patrimonial
damage of considerable
proport
ions
; d) the production of
an
effective
patrimonial
damage
of large
proportions;
e
) the production of
an
effective
patrimonial
damage of extremely large proportions.
