ELEMENTELE CONSTITUTIVE ŞI ELEMENTELE CIRCUMSTANŢIALE AGRAVANTE ALE INFRACŢIUNILOR CONTRA ORDINII ŞI DISCIPLINEI MILITARE

Abstract

Articolul este dedicat analizei juridico-penale a infracţiunilor contra ordinii şi disciplinei militare, prevăzute la art.364-369, 371, 372 CP RM. Sunt examinate elementele constitutive (obiectul, latura obiectivă, latura subiectivă şi subiectul), precum şi elementele circumstanţiale agravante ale acestor infracţiuni. Sunt propuse criterii de delimitare a infracţiunilor specificate la art.364-369, 371, 372 CP RM în raport cu faptele conexe de factură penală sau nepenală. Printre aspectele de noutate ale studiului de faţă trebuie remarcată revizuirea concepţiei de identificare a variantelor-tip şi a variantelor agravate în cazul infracţiunilor prevăzute la art.364 şi 369 CP RM.

This articleis devoted to the juridical-penal analysis of the offenses against military order and discipline under art.364-369, 371, 372 PCRM. There are examined the constituents (the object, the objective side, the subjective side and the subject), as well as the circumstantial aggravating elements of the respective offences. There are also proposed de limitation criteria for the offences specified at art.364-369, 371,372 PC RM with regard to the related acts, penal or non-penal ones. A mongst the new aspects of this study, there should benoted the revision of the identification concept of the variants-type and the aggravated variants with regard to the offences provided by art.364 and 369 PC RM.
