Abstract:
The material or immaterial object is a mandatory secondary sign of the offenses provided in art. 333 and 334 of the Criminal Code. If this sign is missing, then the act cannot be qualified based on art. 333 or 334 of the Criminal Code. In the case of the offenses provided in art. 333 and 334 of the Criminal Code, is illicit remuneration only that entity whose quality of illicit remuneration is aware and accepted by both parties to the criminal transaction. Irrespective of the category of the material or immaterial object of these offenses, the illicit remuneration must be the equivalent of the conduct which the bribed person undertakes to manifest in the interest of the briber.
