În prezentul demers științific ne propunem să oferim răspuns la întrebareacu care el
se deschide: manipularea unui eveniment șipariurile aranjate (art.2421 și 2422
din Codul penal al Republicii Moldova(CP RM)): infracțiuni de corupție? Altfel spus, este oare îndreptățită optica de a raporta infracțiunile de manipularea unui eveniment și
de pariuri aranjate la grupul celor de corupție? Punctul de pornire pentru elaborarea acestei investigații l-a constituit Proiectul de Lege nr.268/2016, care, inter alia urmărește includerea art.2421 și 2422 CP RM printre infracțiunile de corupție. În
acest sens, se constată că fapta exprimată în încurajarea, influenţarea sau instruirea unui participant la un eveniment sportiv sau la un eveniment de pariat să întreprindă acţiuni care ar produce un efect viciat asupra evenimentului respectiv, cu scopul de
a obţine bunuri, servicii, privilegii sau avantaje sub orice formă, care nu i se cuvin, pentru sine sau pentru o altă persoană (art.2421CP RM), precum și fapta de pariere pe un eveniment sportiv sau pe un alt eveniment de pariat, fie în informarea altor persoane despre existenţa unei înţelegeri în privinţa trucării acelui eveniment în intenţia de a le
determina să participe la pariul respectiv, săvârşită de către o persoană care cunoaşte cu certitudine despre existenţa unei înţelegeri privind trucarea acelui eveniment (art.242
2CP RM), nu au cum să se plieze normelor care instituie răspunderea penală pentru
coruperea pasivă (art.324 CP RM), coruperea activă (art.335 CP RM), traficul de influență
(art.326 CP RM), luarea de mită (art.333 CP RM) sau darea de mită (art.334 CP RM). Or, aceste prevederi incriminatoare au raze diferite de acțiune.Se relevă că pentru a atribui o infracțiune sau alta la categoria celor de corupție este ineluctabil ca aceasta să corespundă trăsăturilor definitorii ale corupției, și anume: să afecteze
exercitarea normală a funcţiei; să presupună folosirea de către subiectul actelor de corupţie sau al faptelor de comportament corupţional a funcţiei sale; să se exprim
eîn solicitarea, primirea sau acceptarea, direct sau indirect, pentru sine sau pentru o altă persoană, a unor foloase materiale sau a unui avantaj necuvenit; să se poată
înfățișa în promisiunea, oferirea sau acordarea ilegală a unor asemenea foloase sau avantaje necuvenite subiecţilor actelor de corupţie. Se conchide că infracțiunile prevăzute la art.2421și 2422 CP RM nu se grefează trăsăturilor definitorii ale corupției, acestea având individualitatea lor, deosebindu-sede infracțiunile de corupție. De asemenea, se arată că aceeași concluzie decurge și din textul
Convenţiei Consiliului Europei privind manipularea în competiţiile sportive din 18 septembrie 2014, precum și din actele normative ale unor organizații sportive ce
reglementează răspunderea disciplinară pentru încălcarea eticii în sport. Finalmente, se accentuează că concepţia de a raporta infracțiunile de manipularea unui eveniment și de pariuri aranjate la categoria celor de corupție nu este fundamentată şi urmează a fi abandonată.
This scientific paper aims to give answers to its own introductory question: are the manipulation of an event and the arranged bets (article 2421 and 2422 of the Criminal Code of the Republic of Moldova(CC RM)) corruption offenses? In other words, is it justified to be included the above mentioned offenses to the group of corruption offenses? The starting point for the development of this investigation was the Draft Law no. 268/2016 which, inter alia, aims to incorporate art. 2421 and 2422 of the CC RM among the corruption offenses. In this regard,it is noted that the deed expressed in encouraging, influencing or training a participant at a sporting event or at a betting event to take actions that could
produce a flawed legal effect upon that event, with the aim of achieving goods, services, privileges or advantages in any form, that he should not have had obtained for him or for any other person (art.2421 of the
CC RM), as well as the act of betting on a sporting event or any other event that involves betting, or to inform others about the existenc
e of an agreementon tricking that event with the intention of getting them to participate in that bet, made by a person which does not certainty know about the existence of an agreement about tricking that event (art.2422 of the PC RM), cannot be qualified in the content of norms that establish criminal liability for passive corruption (art.324 of the CC RM), active corruption (art.335 of the CC RM), influence peddling (art.326 of the CC RM), bribery (art.333 and 334 of the CC RM).This is due to the fact that the above-mentioned norms have different scopes. In order to ascribe a criminal offense to the categoryof corruption crimes, it is necessary for such an offense to have the defining characteristics of corruption, namely: to affect the normal exertionof the function; to imply usage by the subject of acts of corruption or acts of corrupt behaviour of his official position; to be manifested through requesting, receiving or accepting, directly or indirectly, for himself orfor another person, undue mater
ial benefits or advantages; to be able to express itself through illegal promising, offering or giving of such undue benefits or advantages to the subjects of acts of corruption. Therefore, the criminal offenses set
forth by art. 2421 and 2422of the CC RM do not have the defining characteristics of corruption, as their individual traits set them apart from corruption crimes. Also, it is shown that the same conclusion results from the text of the Council of Europe Convention on the Manipulation of Sports Competitions of September the 18th, 2014, as well as from the statutes of certain sports organisations that regulate disciplinary liability for violating sports ethics. Finally, it is emphasized
that the concept of ascribing crimes concerning manipulation of an event and arranged bets is not substantiated and shall be relinquished.
