Investigația de față este consacrată analizei justiției restaurative, fiind valorificate în acest sens cadrul legislativ, practica judiciară și abordările doctrinare. Se relevă că justiţia restaurativă este un răspuns la infracțiune, care respectă demnitatea şi egalitatea fiecărei persoane, care clădeşte înţelegerea şi promovează armonia socială, prin vindecarea victimei, a făptuitorului şi a comunităţii. Se accentuează că
justiţia restaurativă este un proces prin care părţile implicate într-un anumit ilicit penal sau contravențional decid în mod colectiv modul cum trebuie rezolvate consecinţele infracţiunii sau ale contravenției şi implicaţiile viitoare. Se subliniază că, în plan internațional, procesele restaurative implică medierea, reconsilierea, conferinţa şi cercurile de verdict. În contrast, în Republica Moldova, înfăptuirea justiției restaurative în
cauze penale presupune recurgerea la mediere și împăcare. De asemenea, se scot în relief incongruențele legislative admise de legiuitor în privința împăcării și medierii în cauze penale, instituții ce produc aceleași consecințe juridice (încetarea procesului), însă care sunt diferite și nu trebuie confundate. Nu în ultimul rând, sunt formulate propuneri de lege ferendamenite să îmbunătățească calitativ cadrul actual de reglementare în materia justiției restaurative.
The following investigation is established for the purpose of making an analysis of the restorative justice, thereby capitalizing the legal framework, case-law and doctrinal approaches. It is revealed that the restorative justice is a response to the crime, which respects the dignity and equality of every human being, which builds comprehension and promotes the social harmony, by healing the victim, the felon and the community. It is accentuated that the restorative justice is a process through which the parties involved in a crime or contravention could decide in a collective method
upon: the manners that settle the consequences of felonies or misdemeanors and the future involvements. It is emphasized
that in an international framework, the restorative processes imply mediation, reconciliation, conferences and sentencing circles. In contrast, in the Republic of Moldova, justice is served with mediation and reconciliation in criminal cases related to restorative justice. The authors have also taken into consideration the legal allowed differences between the mediation and reconciliation, two institutions with the same legal consequences (the termination of the process), but which are dissimilar and must not be confused. Last but not the least, the authors have proposed examples of draft laws and other proposals and approaches that are meant to improve the quality of the actual framework related to restorative justice.
