În articolul de faţă, autorul abordează condiţia depunerii jurământului în raporturile juridice de muncă atipice ale funcţionarilor publici cu statut special: colaboratori ai serviciului vamal, ai organelor apărării, securităţii naţionale şi ordinii publice, precum şi ai altor categorii stabilite prin lege. În privinţa raporturilor de muncă ale acestor categorii de subiecţi, calitatea de sursă primară (izvor primar de reglementare) o deţine legea specială care reglementează statutul subiecţilor în cauză, iar prevederile legii- cadru în materie de funcţie publică şi cele ale Codului muncii se aplică numai în măsura în care nu există suficiente reglementări conţinute în legea specială. În marea majoritate a cazurilor, este vorba despre subiecţi cu statut militar special, militar specializat sau asimilat statutului militar.
In the present article the author approaches the condition of taking the oath in the atypical juridical relations of public servants with special status: employees of customs service, of defense bodies, of national security and public order, as well as other categories stipulated by law. As to the labor relations of these categories of subjects, the quality of the primary source (primary source of regulation) belongs to the special law regulating the status of the officials in question, and the provisions of the framework law in the field of public function and those of the Labor Code are applied only to the extent in which there does not exist sufficient regulations contained in the special law. In the great majority of cases the matter is about the officials with a special military status, military specialized or assimilated to the military status.
