În cadrul studiului sunt supuse interpretării prevederile normative introduse în Codul penal prin Legea nr.75/2016. În contextul interpretării alin.(21) art.186, alin.(21) art.187, alin.(21) art.188, alin.(21) art.190 şi alin.(22) art.191 CP RM, este stabilit conţinutul noţiunilor „bunuri de patrimoniu cultural”, „situri arheologice” şi „zone cu potenţial arheologic”. Se argumenteazăcă infracţiunile prevăzute la art.1991CP RM pot fi comise cu intenţie sau din imprudenţă. În vederea interpretării dispoziţiilor art.1992 CP RM, este identificat emantismul noţiunilor „săpături neautorizate”, „comori”, „lucrări de construcţie”, „alte activităţi de intervenţie asupra solului” şi „certificat de descărcare de sarcină arheologică”. De asemenea, este stabilit criteriul de distincţie între tăinuirea sau păstrarea ilegalăa bunurilor arheologice mobile (în sensul art.1993 CP RM) şi sustragerea acelora ş1) art.186, alin.(21) art.187, alin.(21) art.188, alin.(21) art.190 şi alin.(22) art.191 CP RM). Se demonstrează că administratorul terenului, în care s-a făcut descoperirea arheologică întâmplătoare,
şi/sau reprezentantul responsabil al autorităţii administraţiei publice sunt cei care omit să
anunţe la timp autorităţile publice cu privire la descoperirea întâmplă
toare a bunurilor arheologice mobile (inclusiv a comorilor). Nu în ultimul rând, se relevă
că, în toate cazurile, monumentele de for public posedăcalitatea de monumente care fac parte
din patrimoniul cultural în sensul lit.a) alin.(3) art.1 al Legii privind ocrotirea monumentelor. Utilizând în art.222 CP RM noţiunea „monument de for public”, legiuitorul a luat implicit în considerare faptul că un asemenea monument este un bun aparţinând patrimoniului cultural naţional mobil. Cât priveşte monumentul funerar, şi acesta poate cumula calitatea de
monument care face parte din patrimoniul cultural în sensul lit.a) alin.(3) art.1 al Legii
privind ocrotirea monumentelor. Totuşi, utilizând în art.222 CP RM noţiunea „monument funerar”, legiuitorul nu a luat implicit în considerare faptul că acesta este un bun aparţinând patrimoniului cultural naţional mobil. Drept urmare, profanarea prin distrugere sau deteriorare a unui monument de for public atrage răspunderea exclusiv în conformitate cu art.222 CP RM. Dacă, prin distrugere sau deteriorare, se profanează un monument, care, pe lângăfaptul că este unul funerar, reprezintă un bun de patrimoniu cultural, cele săvârşite vor reprezenta concursul infracţiunilor prevăzute la art.1991 şi 222 CP RM.
Within this study the subject to interpretation was the normative provisions worked in the Penal Code by Law No.75/2016. When interpreting par.(21) art.186, par.(21) art.187, par.(21) art.188, par.(21) art.190 and par.(22) art.191 PCRM,
we established the content of the concepts of „goods of cultural patrimony”, „archaeological sites” and „areas of archaeo-
logical potential”. It is argued then that the offences referred to at art.1991 PC RM can be committed with intention or by negligence. While interpreting the provisions of art.1992 PC RM, we also determined the semantics of the concepts
of „unauthorized diggings”, „treasures”, „construction works”, „other techniques of intervention on the soil” and „archaeological discharge certificate”. Within the analysis process we also established the distinguishing criterion between the acts of concealing or illegal storage of movable archaeological goods (as mentioned in art.199
3 PC RM) and the unlawful removal of the same goods (as mentioned at par.(21) art.186, par.(21) art.187, par.(21) art.188, par.(21) art.190 and par.(22) art.191 PC RM). With this regard it is demonstrated that the managing authority of the area, where the incidental archaeo-
logical discovery has been made, and/or the delegated representative of the public administration authority, are the ones
to hold accountable for omitting to timely notify the public authorities on the made incidental discovery of movable
archaeological goods (including treasures). And not least importa
nt is, as presented in the article, that in all cases, under
lett. a) par.(3) art.1 of the Law on protection of monuments, public monuments have the property of monuments part of
the cultural patrimony. By applying in art.222 PC RM the concept of „public monuments”, the legislature has implicitly
considered that such a monument is a good belonging to the movable national cultural patrimony. As with regard to the
funeral monument, under lett.a) par.(3) art.1 of the Law on protection of monuments, it can encompass the property of
monument part of the cultural patrimony as well. However, when applying in art.222 PC RM the concept of „funeral
monument”', the legislature hasn’t implicitly considered that such a monument is a good belonging to the national mo-
vable cultural patrimony. As a result, the desecration by m
eans of destruction or damage of a public monument involves
penal liability exclusively under art.222 PC RM. If by means of
destruction or damage a monument is desecrated, which,
besides being a funeral monument is also a good of cultural patrimony; the committed acts will form the sum of the
offences provided by both art.1991 and art.222 PC RM
