În prezentul articol este abordată tematica instituţiei consumatorului de resurse energetice în legislaţia şi practica
judiciară a Republicii Moldova şi a Uniunii Europene. Abordarea instituției consumatorului în domeniul energetic în
Republica Moldova trebuie făcută prin prisma a mai mulți factori, inclusiv noțiunea de consumator, istoricul, drepturile
și obligațiile consumatorilor. Expunerea materiei s-a efectuat atât prin prisma legislației Republicii Moldova
cât și normelor Uniunii Europene. În opinia autorului, prezintă interes și legislația României, care este armonizată
cu Directiva 2009/72/CE a Parlamentului European și a Consiliului din 13 iulie 2009 privind normele comune pentru
piața internă a energiei electrice și de abrogare a Directivei 2003/54/ CE și, respectiv, Directiva 2009/73/CE a
Parlamentului European și a Consiliului din 13 iulie 2009 privind normele comune pentru piața internă în sectorul
gazelor naturale și de abrogare a Directivei 2003/55/CE. În scopul îmbunătățirii statutului consumatorului de resurse
energetice e necesar de a revizui cadrul legal primar în materie de protecție a consumatorilor, inclusiv normele ce țin
de statutul lor, drepturile și obligațiunile. O atenție deosebită s-a acordat raporturilor juridice ce reglementează statutul
consumatorului de resurse energetice, inclusiv înaintării unor propuneri de lege ferenda în vederea îmbunătățirii
acestui statut.
This article addresses the issue of the institution of the consumer of energy resources in the legislation and judicial
practice of the Republic of Moldova and the European Union. The approach of the consumer institution in the energy field
in the Republic of Moldova must be done through the prism of several factors, including the concept of consumer, history,
rights and obligations of consumers. The presentation of the matter was carried out both in the light of the legislation of
the Republic of Moldova and the norms of the European Union. According to the author, the Romanian legislation, which
is harmonized with Directive 2009/72 / EC of the European Parliament and of the Council of 13 July 2009 on common
rules for the internal market in electricity and repealing Directive 2003/54 / EC, is also of interest, respectively Directive
2009/73 / EC of the European Parliament and of the Council of 13 July 2009 on common rules for the internal market
in natural gas and repealing Directive 2003/55 / EC. In order to improve the consumer status of energy resources, it is
necessary to review the primary legal framework on consumer protection, including the rules on their status, rights and
obligations. Particular attention has been paid to the legal relationships governing the status of the consumer of energy
resources, including the submission of legislative proposals to improve this status.
Dans cet article, le sujet de l’institution du consommateur de ressources énergétiques dans la législation et la pratique
judiciaire de la République de Moldova et de l’Union Européenne est abordé. L’approche de l’institution de protection
des consommateurs dans le secteur de l’énergie en République de Moldova devrait être fondée sur plusieurs facteurs,
notamment la notion de consommateur, l’histoire, les droits et les obligations des consommateurs. L’exposé de la ques-
tion a été réalisé à la fois à travers le prisme de la législation de la République de Moldova et des normes de l’Union
Européenne. De l’avis de l’auteur, la législation roumaine présente également un intérêt, qui est harmonisée avec la
directive 2009/72/CE du Parlement Européen et du Conseil du 13 juillet 2009 relative à des règles communes pour le
marché intérieur de l’électricité et abrogeant la directive 2003/54/CE et la directive 2009/73/CE du Parlement Européen
et du Conseil du 13 juillet 2009 relative à des règles communes pour le marché intérieur du gaz naturel et abrogeant la
directive 2003/55/CE. Afin d’améliorer le statut du consommateur de ressources énergétiques, il est nécessaire de réviser
le cadre juridique principal de la protection des consommateurs, y compris les règles relatives à leur statut, à leurs droits
et à leurs obligations. Une attention particulière a été accordée aux relations juridiques régissant le statut du consommateur
de ressources énergétiques, y compris la soumission de propositions pour lege ferenda afin d’améliorer ce statut.
В данной статье рассматривается вопрос института потребителя энергоресурсов в законодательстве и
судебной практике Республики Молдова и Европейского Союза. Подход института потребителей в области
энергетики в Республике Молдова должен осуществляться сквозь призму нескольких факторов, включая поня-
тие потребителя, историю, права и обязанности потребителей. Презентация темы была сделана как с точки
зрения законодательства Республики Молдова, так и норм Европейского Союза. По мнению автора, также
представляет интерес румынское законодательство, гармонизированное с Директивой 2009/72/ЕС Европейского
парламента и Совета от 13 июля 2009 г. об общих правилах внутреннего рынка электроэнергии и отменяющее
Директиву 2003/54/ЕС, соответственно, Директива 2009/73/ЕС Европейского парламента и Совета от 13
июля 2009 года об общих правилах внутреннего рынка природного газа и отменяющая Директиву 2003/55/ЕС. В
целях улучшения статуса потребителя энергоресурсов, необходимо пересмотреть первичную правовую базу по
защите прав потребителей, в том числе нормы, касающиеся их статуса, прав и обязанностей. Особое внимание
было уделено правоотношениям, регулирующим статус потребителя энергоресурсов, в том числе внесение законодательных
предложений по совершенствованию этого статуса.
