Formularea noțiunii și importanţa contractelor de furnizare a serviciilor în domeniul energetic urmează a fi făcută
reieșind din prevederile Codului civil și legilor speciale aplicabile în domeniul energetic, inclusiv jurisprudența. Cercetările efectuate au avut drept scop evidențierea unor aspecte referitoare la redefinirea contractelor de furnizare a
energiei electrice și gazelor naturale într-o nouă redacție. În acest scop, a fost analizată noţiunea, natura juridică şi
importanţa contractelor de furnizare a serviciilor în domeniul energetic. De asemenea, au fost determinate conceptele
ce stau la baza contractelor de furnizare a serviciilor în domeniul energetic. Nu mai puțin importante sunt, în acest
sens, și prevederile Codului civil al Republicii Moldova care au transpus Directiva (UE) 2011/83 privind consumatorii.
În prezentul articol o atenție deosebită a fost acordată și doctrinei, întrucât istoricul evoluției instituției contractelor
are un rol important și asupra contractelor de furnizare a serviciilor în domeniul energetic. În același context,
prezintă un interes deosebit jurisprudența.
The wording of the notion and the importance of contracts for the provision of services in the energy field are
to be made based on the provisions of the Civil Code and the special laws applicable in the energy field, including
jurisprudence. The research was aimed at highlighting some aspects related to redefining the contracts for the supply
of electricity and natural gas in a new wording. To this end, the notion, the legal nature and the importance of service
contracts in the energy field were analyzed. Also, the concepts underlying the contracts for the provision of services in
the energy field were determined. No less important in this respect are the provisions of the Civil Code of the Republic
of Moldova which transposed (EU) Directive 2011/83 on consumers. In this article, special attention has also been
paid to the doctrine, as the history of the evolution of the institution of contracts also has an important role to play in
the provision of services in the field of energy. In the same context, the case law is of particular interest.
Formulation et importance des contrats de prestation de services dans le domaine de l'énergie seront établis sur
la base des dispositions du Code civil et des lois spéciales applicables dans le domaine de l'énergie, y compris la
jurisprudence. La recherche visait à mettre en évidence certains aspects de la redéfinition des contrats de fourniture
d'électricité et de gaz naturel dans un nouvel éditorial. À cette fin, le concept, la nature juridique et l'importance des
contrats de prestation de services dans le domaine de l'énergie ont été analysés. Les concepts sous-jacents aux contrats
de prestation de services dans le domaine de l'énergie ont également été déterminés. Non moins importantes sont, à cet
égard, les dispositions du Code civil de la République de Moldova qui a transposé la directive (UE) 2011/83 sur les
consommateurs. Dans cet article, une attention particulière a également été accordée à la doctrine, car l'histoire de
l'évolution de l'institution des contrats joue également un rôle important sur les contrats de prestation de services dans
le domaine de l'énergie. Dans le même contexte, la jurisprudence présente un intérêt particulier.
Формулировка понятия и значения договоров об оказании услуг в области энергетики должна производиться
на основе положений Гражданского кодекса и специальных законов, действующих в области энергетики,
в том числе судебной практики. В результате проведённых исследований, акценты были сосредоточены на
некоторые аспекты, связанные с пересмотром договоров на поставку электроэнергии и природного газа в
новой редакции. Для этого были проанализированы понятие, правовая природа и значение договоров об оказании
услуг в сфере энергетики. Также были определены понятия, лежащие в основе таких договоров. не менее
важными в этом отношении являются положения Гражданского кодекса Республики Молдова, которые были
приведены в соответствии с Директивой (ЕС) 2011/83 о потребителях. В данной статье особое внимание
было уделено доктрине, поскольку история эволюции института контрактов также играет существенную
роль при заключении контрактов на оказание услуг в данной области. В этом же контексте, особый интерес
представляет юриспруденция.
